A car belonging to Stella Barker was stolen from a parking lot on June 11 between 10:35 and 11:05 PM.Two police officers observed the vehicle at a convenience store about 1:20 AM.Streep was driving the car and Howe was slumped in the passenger’s seat. The officers became suspicious because of the late hour, the cautious manner in which Streep was walking after exiting the car, and the fact that Howe appeared to be hiding. The police, who followed the car and determined that it was stolen, turned on their flashing lights and siren.Streep refused to stop, driving away at speeds in excess of 100 mph.Streep lost control and crashed in a field.One officer apprehended Howe who had gotten out of the car immediately after the accident and appeared ready to run.
Earlier in the day, Howe was watching television at a friend’s home when Streep, the friend’s boyfriend, joined them.Howe testified that this was the first time he met Streep.Eventually, Streep left for several hours and then returned and invited Howe to ride in the car.Howe recalled that he was suspicious about the ownership of the vehicle because Streep, a teenager, seemed too young to own such a nice car, but that Streep stated that the car belonged to his cousin.Howe claims that he first learned the car was stolen when Streep admitted it as they left the convenience store and saw the police following the vehicle.Barker testified that the steering wheel had been damaged and that Streep had driven the car without keys.She also testified that papers, including the registration card and business cards with her name on them, had been removed from the glove compartment and were on the floor of the car.A picture of her daughter was displayed on a visor.Could Howe be found guilty of receiving stolen property?
